What Is the California Lemon Law?

The Tanner Consumer Protection Act of California, commonly referred to as the "California Lemon Law," gives consumers the right to their money back or a new car if their vehicle cannot be repaired after a reasonable number of attempts.

The California Lemon Law is not only for new cars. Used cars that are still protected by the manufacturer's warranty are also covered under the California Lemon Law.

What To Do If You Think You Have Bought A Lemon Car

If you think the car you bought is a lemon and you want your money back or another car, protect yourself by doing the following things:

  • When you go to the Mercedes dealership to have your lemon car repaired, insist that the service representative write down all of your complaints.
  • Make sure you get a written repair order each time you bring your lemon car to the Mercedes dealership to be fixed.
  • Keep all of the repair orders for your Mercedes in a safe place where you can find them when you need them.
  • If your Mercedes cannot be repaired and you suspect it is a lemon, notify:

  • If Mercedes insists, allow their representative to inspect the car before you decide to file a lemon law lawsuit.
  • If you are entitled to your money back pursuant to the California Lemon Law, Mercedes is entitled to a deduction for mileage. This deduction is based on the number of miles on the car the first time you took your Mercedes in to repair the (lemon law) problem.
